CustomerDashboard Terms of Use

These Terms of Use (the Terms) govern access to CustomerDashboard.io and related services (the Service) provided by CustomerDashboard (CustomerDashboard, we, us). By creating an account, placing an order, or using the Service on behalf of a business, you agree to these Terms for that business (the Customer). You confirm that you have authority to do so.
1. Business use only
The Service is offered only to businesses and persons acting for business purposes. It is not offered to consumers for personal use.
2. The Service
The Service lets Customers connect a database and create dashboards or client portals using information from that database. The Service queries the database and may temporarily cache query results. CustomerDashboard does not intentionally write to a connected database.
Customers should provide credentials limited to read-only access and only to the data required for the Service. Unless expressly agreed otherwise, the Service does not include data migration, data export, custom development, guaranteed support times, or a service-level commitment.
We may improve, change, limit, or discontinue parts of the Service. We will try to give reasonable notice of a material change that significantly reduces paid functionality.
3. Accounts and access
The Customer is responsible for:
- keeping account and database credentials secure;
- giving access only to authorised users;
- its users, administrators, sub-clients, and their use of the Service;
- promptly removing access that is no longer needed; and
- notifying us promptly of suspected unauthorised access.
The Customer must provide accurate account and billing information.
4. Customer data and responsibilities
Customer Data means information, content, database results, dashboard configurations, and other material submitted to, connected to, or displayed through the Service by or for the Customer.
The Customer retains its rights in Customer Data. The Customer gives CustomerDashboard a limited right to access, process, cache, transmit, and display Customer Data only as needed to provide, secure, maintain, and support the Service and comply with law.
The Customer decides what data to connect, how dashboards are configured, and whether a dashboard is private, link-accessible, or public. The Customer is solely responsible for:
- having all necessary rights, notices, agreements, and lawful bases for Customer Data;
- its relationship and contracts with its clients and sub-clients;
- configuring access and sharing correctly;
- the legality, accuracy, and quality of Customer Data;
- responding to requests from individuals concerning Customer Data; and
- determining whether the Service is appropriate for its data, industry, and use case.
The Service is not designed or certified for payment-card data, protected health information, government identification numbers, biometric or genetic data, children’s data, or other information subject to heightened legal or industry requirements. The Customer must not use the Service for such information unless it has independently determined that the use is lawful and that the Service and the Customer’s own safeguards are appropriate. CustomerDashboard does not accept sector-specific obligations, including HIPAA or PCI DSS obligations, unless agreed in a separate signed contract.
The Customer must not use the Service to break the law; infringe rights; distribute malware; gain unauthorised access; interfere with the Service; conduct unlawful surveillance or discrimination; or make illegal, harmful, or confidential information publicly available.
5. Public and shared dashboards
The Customer controls whether and with whom it shares a dashboard. Anyone who receives a public or shareable link may be able to access the dashboard. The Customer must review the dashboard and its permissions before sharing it.
We may restrict or remove access to a dashboard that appears to violate these Terms, expose data unlawfully, threaten the Service, or infringe another person’s rights.
6. Fees, renewal, cancellation, and refunds
Subscriptions are billed monthly in advance and renew automatically until cancelled. Payments may be processed by Lemon Squeezy or another payment provider under that provider’s terms.
The Customer may cancel at any time. Cancellation stops the next renewal, and access normally continues until the end of the current paid month. Fees for the current month and partial months are non-refundable, except where required by law. We may choose to issue a refund or credit for a serious technical problem, but doing so does not create an obligation to provide future refunds.
Prices exclude taxes unless stated otherwise. The Customer is responsible for applicable taxes. We may change prices for a future billing period after reasonable notice.
7. Intellectual property
CustomerDashboard and its licensors own the Service, software, design, documentation, and related intellectual property. These Terms give the Customer a limited, non-exclusive, non-transferable right to use the Service during its subscription for its internal business and client-portal purposes.
The Customer must not copy, resell, reverse engineer, or attempt to extract the source code of the Service, except where applicable law does not allow that restriction.
If the Customer gives us feedback, we may use it without restriction or payment, provided we do not identify the Customer publicly without permission.
8. Confidentiality
Each party must use reasonable care to protect non-public information received from the other and use it only for the relationship under these Terms. This does not cover information that is public through no breach, already lawfully known, independently developed, or lawfully received from another source. A party may disclose information when legally required, where permitted after giving reasonable notice.
9. Privacy and data processing
Our Privacy and Cookie Policy applies to personal data we process for our own purposes. When CustomerDashboard processes personal data in Customer Data on the Customer’s behalf, the CustomerDashboard Data Processing Addendum applies and forms part of these Terms.
10. Third-party services
The Service relies on third-party providers for infrastructure, authentication, payments, and analytics. Separately, at the Customer’s direction, the CustomerDashboard application connects to the Customer’s database. Third-party providers other than our hosting infrastructure are not intended to connect to the Customer’s database or receive its credentials or contents. The Customer is responsible for maintaining its database, providing appropriate permissions, complying with applicable third-party terms, and ensuring that it is authorised to connect the database to the Service.
11. Availability and disclaimers
The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, error-free operation, permanent storage, or that dashboards or analytics will be accurate, complete, or suitable for a particular decision or purpose.
The Customer remains responsible for its source database, independent backups, decisions, and business operations. To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
12. Suspension and termination
We may suspend access where reasonably necessary to protect the Service, prevent unlawful use, address a security risk, respond to non-payment, or enforce these Terms. Where practical, we will give notice and an opportunity to correct the issue.
Either party may terminate for a material breach that is not corrected within a reasonable time after notice. The Customer may also terminate by cancelling its subscription.
After termination, access ends and no export of dashboard configuration or cached data is guaranteed. Database access credentials will be disabled or deleted promptly. Cached Customer Data and active dashboard configurations will normally be deleted within 30 days. Residual copies may remain in backups for up to 90 days, and records may be retained where required for security, billing, disputes, or law.
13. Liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profits, revenue, business, goodwill, or data.
To the fullest extent permitted by law, CustomerDashboard’s total liability arising out of or relating to the Service or these Terms will not exceed the subscription fee paid by the Customer for the one month immediately before the event giving rise to the claim.
These limitations do not apply to liability that cannot legally be excluded or limited, including liability for fraud or intentional misconduct. The Customer is responsible for claims resulting from its unlawful Customer Data, sharing choices, or use of the Service in breach of these Terms.
14. Changes to these Terms
We may update these Terms. We will post the updated version and revise the effective date. For a material change, we will provide reasonable advance notice where practical. Continued use after the change takes effect means the Customer accepts the updated Terms. If the Customer does not agree, it must stop using the Service and cancel before the change takes effect.
15. General
Neither party is liable for delay caused by events beyond its reasonable control. The Customer may not transfer these Terms without our consent. We may transfer them as part of a merger, reorganisation, financing, or sale of the Service or business. If part of these Terms is unenforceable, the remainder stays effective. Failure to enforce a term is not a waiver.
These Terms and the documents incorporated into them are the entire agreement concerning the Service and replace earlier discussions on the same subject.
Finnish law governs these Terms, excluding its conflict-of-law rules. The courts of Helsinki, Finland have exclusive jurisdiction, unless applicable law requires otherwise.
